This policy applies to data processing within PS Plattformen & Systeme GmbH as well as to the use of our website. The legal basis for this data processing is the General Data Protection Regulation (GDPR) and the Austrian Data Protection Act (DSG).

1 Data processing in general

1.2 Data processing in accordance with Art. 13 GDPR

We process data that is provided to us by various individuals through their own actions, such as in the context of an enquiry by email or for the purpose of initiating and concluding a contract or business relationship.

1.3 Data processing in accordance with Art. 14 GDPR

In addition, we also process data that is not provided directly by the data subject. This is the case, for example, when management bodies provide us with the names and contact details of their employees in the context of projects or business relationships.

1.4 Data subjects

The following data is processed from interested parties: Company, name of the contact person and professional contact details and address data.

The following data is processed from suppliers and business partners: company name, names of contact persons, professional address and contact details, bank details and contract data.

We publish the names of authors upon request. As soon as the use of the works is discontinued, the personal data is automatically deleted.

1.5 Legal basis

The legal basis for data processing is:

  • Consent (e.g. for the processing of images) in accordance with Art. 6 para. 1 lit. a GDPR
  • Contract initiation and fulfilment Art. 6 para. 1 lit. b GDPR
  • Legal obligations (e.g. statutory storage and documentation obligations, publication obligations under copyright law) pursuant to Art. 6 (1) lit. c GDPR
  • Legitimate interests of our company (e.g. use of software) pursuant to Art. 6 (1) lit. f GDPR

We will inform you separately about the legal basis and purpose of the processing for each of the data processing operations described below.

1.6 Transfer of data

Data will be transferred exclusively for the purpose of fulfilling the contract in accordance with Art. 6 para. 1 lit. b GDPR in order to provide you with our services.

  • Transfer within the group: The personal data collected will be transferred within the group to parent companies and subsidiaries if necessary. This is necessary because various group companies provide IT services, among other things. The transfer is based on internally concluded contracts.
  • Transfer to processors: We work with processors to whom personal data is transferred in order to provide services efficiently. These include companies that perform tasks such as contract fulfilment, payment processing, account management and IT services.
  • Other transfers: In certain cases, such as legal obligations or in the context of a legal dispute, personal data may be disclosed to authorities or lawyers.

1.7 Storage/deletion/anonymisation of data

  • Contractual storage obligations: After termination of a contractual relationship or after the end of contractually agreed periods, personal data will be deleted or anonymised as soon as there are no legal obligations to retain it.
  • Revocation of consent: If consent to the processing of personal data is revoked, the data will be deleted and anonymised, unless there is another legal basis for processing.
  • Statutory retention obligations: The controller is subject to various statutory retention obligations. After expiry of these statutory retention obligations, personal data will be deleted or anonymised. It may happen that personal data must be retained for legal reasons despite the revocation of consent or the expiry of contractually agreed periods and will only be deleted at a later date (after expiry of the respective statutory periods). 2 Contact

When you contact us by email, telephone or contact form, the data you provide will be stored for the purpose of processing your enquiry. Depending on the content and responsibility, it may be necessary to forward your enquiry to one of our subsidiaries for further processing, provided this is necessary for proper processing.

3 Application management

General: If you send us your application documents, we will process the personal data contained therein for the purpose of personnel selection and job placement.

Legal basis: Art. 6 para. 1 lit. b GDPR (contract initiation and fulfilment)

Deletion: In the event of rejection, we will delete your documents 7 months after sending you the rejection.

Legal basis: Art. 6 para. 1 lit. f GDPR (legitimate interest)

Record keeping: If we wish to keep your details on file for future contact, we will send you a separate request for your consent. If you give us your explicit consent, we will store your application documents. If no further job opportunities arise within one year of receiving your consent, we will delete all your application documents.

4 Whistleblowing system

We have set up a whistleblowing system (Saubermacher Group online whistleblowing portal) on our website. The whistleblowing system enables you to contact us and report compliance and legal violations without fear of reprisals. 5 Wastebox.biz app/web portal

5.1 Wastebox.biz app

Our customers can use our Wastebox.biz app to order the right waste containers for construction sites, including their delivery and collection of filled containers for waste disposal.

In doing so, we process customer data such as name, address, telephone number, email address, as well as the name and contact details of contact persons (e.g. construction site managers). This data processing is necessary for the performance of our services. The data will be deleted by us as soon as you delete your profile in the Wastebox app and the statutory retention obligations have expired.

5.2 Login

Our customers have the option of logging in to our website with their login details to view all information, such as orders, construction site details, disposal costs, delivery notes, etc., in real time. For this purpose, we require your email address and password.

The data processing is used exclusively for the use of the web portal. The data we collect is stored for as long as you have an account with us and is deleted as soon as it is no longer subject to statutory retention obligations.

6 Data processing when using our website

6.1 Informational use of the website

When you use our website for informational purposes only, we only collect the personal data that your browser transmits to our server (server log files). When you visit our website, we collect the data that is technically necessary for us to display our website to you and to ensure stability and security:

  • IP address
  • Date and time of the request
  • Time zone difference to Coordinated Universal Time (UTC)
  • Content of the request (specific page)
  • Access status/HTTP status code
  • Website from which the request originates
  • Browser
  • Operating system and its interface
  • Language and version of the browser software

This data is not merged with personal data sources. We reserve the right to check this data retrospectively if we become aware of specific indications of illegal use and to pass the data on to the law enforcement authorities in the event of a cyber attack. No further disclosure to third parties will take place.

7 Borlabs Cookie (consent management)

Our website uses the consent management tool ‘Borlabs Cookie’ from Borlabs GmbH, Hamburger Str. 11, 22083 Hamburg, Germany.

The service uses a technically necessary cookie (borlabs-cookie) to store your cookie consent. The consent management tool records and stores the cookie selection of each user of our website. The express consent of the website visitor ensures that statistical and marketing cookies are only set after consent has been given.

8 Data processing for Google services

We use services provided by Google Ireland Limited (‘Google’), a company registered and operating under Irish law with its registered office at Gordon House, Barrow Street, Dublin 4, Ireland, on our website.

8.1 Google Analytics

We use Google Analytics on our website, a tool that allows us to analyse how our website is used. With Google Analytics, we can see how many people visit our website and how long they stay.

This website uses the ‘IP anonymisation’ feature (i.e. Google Analytics has been extended by the code ‘gat._anonymizeIp();’ to ensure anonymous collection of IP addresses (so-called IP masking)). This means that your IP address will be truncated by Google within member states of the European Union or in other states party to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transferred to a Google server in the United States and truncated there.

8.2 Google Tag Manager
